Insolvency resolution methods of natural persons non-entrepreneurs in the Czech republic

The bachelor thesis presents the insolvency resolution methods for a natural person non-entrepreneur (consumer). Firstly there is presented the definition of a bankruptcy in general and also all possible methods of its solution that is defined in czech insolvency law. The emphasis is put on the two main methods: the bankruptcy and the personal bankruptcy. This bachelor thesis concerns the comparison of those two mentioned methods and tells which of it is considered to be better for a debtor and what are the main reasons.

This bachelor thesis presents and describes insolvency resolution methods of natural persons according to actual Czech insolvency act. In connection with a significant increase of initiated insolvency proceedings in last three years is this thesis focused on extremely indebted households. First part deals with basic concepts and phases of whole proceeding. In second part reader discovers particular resolution methods, which are well known bankruptcy leading to liquidation and new institute of personal bankruptcy. These chapters clearly define differences, positives and negatives connected with each resolution method. Last part refers to specific advantage for debtors, which comes with personal bankruptcy. The analysis, necessary for creating this part, is based on real data from insolvency register.
Indebtedness of Czech households and the institute of personal bankruptcy

The paper in the field of personal and family finances is focused on the current situation of indebtedness of Czech households and the comparison in the context of the European countries. It analyses the development of indebtedness and personal bankruptcies before the crisis and nowadays. The paper presents the possibilities of prevention of excessive debts. It describes the institute of personal bankruptcy and deals with the possibility of its application to the subjects with excessive debts. Therefore, the paper summarizes the advantages and the risks of the application of the personal bankruptcy in practice.
